Eze Fixture Repairman App

Service Provider Terms and Conditions

Effective Date: September 30, 2026

These Service Provider Terms and Conditions (“Terms”) govern the use of the Fixture Repairman mobile application, website and related services (collectively, “Fixture” or the “Platform”) by repair professionals, mechanics, tire shops, garages, companies, technicians and other automotive service providers (“Service Providers”, “Repairmen” or “you”).

Fixture provides technology that connects Service Providers with customers requesting automotive services. By creating a Service Provider account, accepting a service request or using Fixture, you agree to these Terms. These Terms should be read together with the Fixture Repairman App Privacy Policy, Service Provider Standards, Cancellation and Refund Responsibilities.

  1. Agreement and Authority

If you use Fixture on behalf of a company, tire shop, garage or other business, you represent that you are authorized to bind that business to these Terms. The business and the individuals operating through its Fixture account are responsible for complying with these Terms and applicable law.

Fixture may require identity, business, licence, permit, certification, insurance, banking, payout or other verification information where reasonably necessary for onboarding, compliance, payment processing or safety.

  1. Nature of the Platform and Service Provider Relationship

Fixture is a technology platform that connects Service Providers with customers requesting automotive services. Fixture’s approval of an account does not make Fixture the provider of the automotive work and does not replace your professional, licensing, safety or legal responsibilities.

Unless a separate written agreement states otherwise, you remain an independent Service Provider responsible for deciding whether to accept available jobs, for the services you offer, and for the quality, legality and safety of the work you perform.

You are responsible for the actions of your employees, contractors and technicians when they provide services through your Fixture account.

  1. Account Information and Verification

You must provide accurate and current registration information, including your name, business or garage name, contact details, business address, service location, service offerings, pricing, working hours, availability, travel charges, service area and other information reasonably required by Fixture.

Where requested, you must provide truthful and current documents or information used for verification. Providing false, expired or misleading permit, licence, qualification or other verification information may result in restriction, suspension or termination.

  1. Legal Compliance, Permits and Authorizations

You and the company, tire shop or garage for which you work must operate lawfully and comply with all applicable federal, provincial and municipal laws, regulations, bylaws, licensing requirements, workplace requirements and automotive-service requirements in the jurisdiction where work is performed.

You must maintain all permits, licences, registrations or authorizations required to legally operate the business and provide the services offered through Fixture. Where a municipal garage permit or similar business authorization is required, it must remain valid and current.

Where insurance or other financial responsibility is required by law or by a separate agreement with Fixture, you are responsible for maintaining that coverage in valid status.

  1. Service Profile, Pricing and Availability

You are responsible for keeping your service offerings, prices, working hours, availability, service area and properly disclosed travel or dispatch charges reasonably accurate in Fixture.

You must not intentionally display misleading prices or add undisclosed charges after a customer has accepted a service request. Additional work or charges must be handled in accordance with the customer-authorization requirements in these Terms.

  1. Accepting and Performing Jobs

You should accept only jobs you reasonably expect to complete. Before accepting, you should consider your service area, tools, staff, qualifications, customer information and the nature of the requested service.

After accepting a job, you are responsible for attending and performing the authorized service unless a legitimate reason prevents completion, such as an emergency, safety concern, inability to perform the required work, incorrect customer information or circumstances reasonably outside your control.

  1. Customer Information and Confidentiality

Fixture may provide customer information necessary to perform an accepted job, including the customer’s name, contact information, service location, vehicle details, requested service, appointment information and customer instructions.

Customer information is confidential. You may use it only to perform, document and support the authorized Fixture job or as otherwise permitted by law. You must not sell customer information, disclose it for unrelated purposes, copy it unnecessarily, use it for unauthorized marketing, harass customers or solicit them in a manner inconsistent with legitimate business purposes.

Access to customer information should be limited to employees or technicians who reasonably need it to perform the service.

  1. Location Information and Accuracy

The Repairman App may use precise location information to identify nearby customer requests, determine eligibility for mobile jobs, calculate travel distance, show your location during an active service, provide navigation or tracking, verify arrival, or support safety and dispute resolution.

You must not manipulate, falsify or intentionally misrepresent your location. Depending on the feature and device permissions, location information may continue to be collected during an active job or while travelling to the customer.

  1. Professional and Respectful Conduct

You, your employees and your technicians must treat Fixture customers professionally and respectfully. You must not threaten, intimidate, harass, discriminate against, abuse or engage in inappropriate conduct toward a customer.

You must respect the customer’s property, vehicle, service location and privacy. Serious or repeated violations may result in account restriction, suspension or termination and may be reported to appropriate authorities where required.

  1. Proper Tools, Safety and Professional Procedures

You must use proper professional tools, equipment and procedures appropriate for the service being performed and perform work according to applicable safety standards, manufacturer specifications and accepted automotive-service practices.

For wheel and tire services, this includes appropriate lifting and installation procedures and use of the correct torque specification with suitable calibrated equipment where required. Tire pressure must be set to the appropriate PSI based on the applicable vehicle, tire or manufacturer specification.

You must not intentionally guess torque values, use clearly unsuitable equipment or perform work you are not competent or legally permitted to perform.

  1. Service Authorization and Additional Work

You may perform only work authorized by the customer or included in the accepted Fixture service request.

If additional work becomes necessary, you must explain the additional work and obtain the customer’s authorization before performing or charging for it, except where immediate action is reasonably necessary to address an emergency safety situation.

You must not intentionally add unauthorized services, charges, parts or fees to a customer’s order.

  1. Vehicle Care and Damage Responsibility

You and the repair company, garage or tire shop performing the work are responsible for direct damage to a customer’s vehicle caused by your work, negligence, improper equipment, improper procedures or the actions of employees or technicians performing the job.

Depending on the circumstances, this may include scratched, chipped, bent or damaged rims; tires torn, punctured or damaged during removal, installation or repair; damage caused by improper lifting or jacking; incorrect installation; body or interior damage; damage caused by improper torque; and other direct damage caused while performing the authorized service.

Where appropriate, you should inspect and document visible pre-existing damage before beginning work. If damage occurs during the job, you must inform the customer and Fixture promptly and must not intentionally conceal the damage.

You agree to cooperate in resolving legitimate vehicle-damage claims. Nothing in these Terms removes responsibilities imposed on you under applicable law.

  1. Required Service Records

After completing a job, you must accurately record the work performed and make the relevant service record available to the customer through Fixture or another authorized method.

Where applicable, the service record should include the Fixture job identification, vehicle make, model and year, tire or rim information, service performed, parts or materials used, wheel torque measurement or specification, tire PSI, additional work authorized by the customer, date and time of service, Service Provider or technician information and relevant observations concerning the vehicle.

You must not knowingly falsify service records, torque measurements, PSI values or other work information. Fixture may retain these records as part of the customer and Service Provider transaction history.

  1. Completion of Work

You should mark a job as completed only after the authorized service has actually been performed.

Submitting a completed status for work that was not performed, intentionally misrepresenting service results or charging for work that was not completed may result in a customer refund, payment withholding or adjustment, investigation, account restriction, suspension or termination.

  1. Service Provider Cancellation

After accepting a customer request, you should not cancel except for a legitimate reason such as an emergency, safety concern, inability to perform the required service, incorrect customer information or circumstances reasonably outside your control.

If cancellation becomes necessary, you must notify Fixture promptly. Repeated unjustified cancellations, intentional delays or Service Provider no-shows may negatively affect account standing and may result in restrictions or suspension.

You may not charge a customer for work that was not performed.

  1. Customer Cancellation and Dispatch Charges

If a customer cancels before you begin travelling or incur costs, you will normally not be entitled to payment for unperformed work.

Where a properly disclosed cancellation or dispatch charge applies after travel has begun, Fixture may process the applicable charge according to the cancellation terms shown to the customer. You must not create or demand an undisclosed cancellation charge.

  1. Payments, Payouts, Fees and Taxes

Fixture or its payment partners may collect and process information necessary to handle customer payments, Service Provider payments, refunds, adjustments and account reconciliation. This may include banking or payout information, transaction amounts, service charges, refunds, payment status and tax-related records.

Any Fixture platform fee, service fee, payment-processing charge or other amount payable by you, if applicable, must be disclosed through the Platform or a separate agreement before it becomes payable. Nothing in these Terms creates an undisclosed commission or fee.

You are responsible for taxes, registrations, filings and similar obligations applicable to your business or earnings to the extent required by law. Fixture may retain or report transaction information where required by applicable law.

  1. Refunds, Payment Adjustments and Disputes

Fixture may review a transaction where a customer reports that you did not attend, the requested work was not performed, unauthorized work was charged, the customer was materially overcharged, a transaction was charged more than once, the work was materially incomplete or improperly performed, or another legitimate billing or service issue occurred.

Where supported by available information and permitted by applicable agreements and law, Fixture may issue a refund, partial refund, payment adjustment or payment reversal. You agree to cooperate with reasonable investigations and provide service records, photographs, invoices, job details or other relevant information.

Where a refund results from your failure, unauthorized charge, misconduct or other responsibility, you may be responsible for the relevant adjustment in accordance with your agreement with Fixture and applicable law.

  1. Customer Vehicle and Property

The customer’s vehicle and property must be handled with reasonable care. You may not use the customer’s vehicle for unrelated purposes, remove property without authorization or intentionally interfere with vehicle systems beyond what is reasonably necessary to perform the authorized service.

Keys, wheel-lock keys or other property provided by a customer must be returned promptly upon completion of the service.

  1. Employees, Contractors and Technicians

If other people perform work through your Fixture account, you are responsible for ensuring they are appropriately qualified, supervised where required, authorized to perform the work, and informed of the customer-data, safety, conduct and service-record obligations in these Terms.

You remain responsible for their acts and omissions in connection with Fixture jobs to the extent provided by applicable law.

  1. Prohibited Conduct

You must not use Fixture to commit fraud, falsify service records or location data, submit false qualifications, misuse customer information, charge for work not performed, add unauthorized charges, manipulate Platform systems, attempt unauthorized access, threaten or harass customers, or perform services you are not competent or legally permitted to perform.

You must not use the Platform in a manner that creates an unreasonable safety or security risk for customers, Fixture or other users.

  1. Privacy and Security

Fixture’s collection, use, disclosure, retention and deletion of Service Provider information is described in the Fixture Repairman App Privacy Policy.

You must take reasonable precautions to protect customer information and promptly inform Fixture if you reasonably believe customer or Fixture information has been accessed, disclosed or compromised without authorization.

  1. Account Suspension, Termination and Data Retention

Fixture may restrict, suspend or terminate a Service Provider account where Fixture reasonably determines that the Service Provider violated these Terms or Fixture policies, endangered customers, provided fraudulent information, operated without required permissions, misused customer information, repeatedly failed to complete accepted jobs or engaged in conduct inconsistent with safe and professional automotive services.

You may request account deletion through available account-management functionality or by contacting Fixture. Certain payment, tax, completed-service, safety, complaint, dispute or legal records may need to be retained after account closure where reasonably necessary or legally required.

  1. Fixture Intellectual Property and Platform Licence

The Fixture name, Platform, software, interface, branding, graphics, text and other Platform materials are owned by Fixture or its licensors and are protected by applicable intellectual-property laws.

Fixture grants you a limited, non-exclusive, non-transferable and revocable right to use the Repairman App for legitimate Service Provider activities. You may not copy, sell, sublicense, reverse engineer, interfere with or commercially exploit the Platform except where applicable law expressly permits such activity.

  1. Platform Availability and Third-Party Services

Fixture may rely on third-party providers for payment processing, cloud hosting, authentication, maps and geolocation, push notifications, application monitoring, analytics, crash reporting and customer support.

Fixture does not guarantee uninterrupted or error-free Platform availability. Connectivity, third-party systems, device permissions and other circumstances outside Fixture’s reasonable control may affect access to jobs, navigation, payments or other functionality.

  1. Disclaimers and Service Provider Responsibility

You remain responsible for the quality, legality and safety of the automotive services you perform. Using Fixture does not transfer your professional obligations to Fixture.

Fixture does not guarantee any particular number of customer requests, jobs, earnings, service areas or payment volume. Nothing in these Terms excludes any right or obligation that cannot legally be excluded.

  1. Limitation of Liability and Responsibility for Claims

To the maximum extent permitted by applicable law, Fixture will not be liable for indirect, incidental, special, consequential or punitive losses arising solely from your independent business operations, your automotive work, customer conduct or third-party services. Fixture does not exclude liability that applicable law does not permit it to exclude.

You are responsible for losses, claims or costs resulting from your negligence, unlawful conduct, unauthorized work, vehicle damage, misuse of customer information, fraudulent activity or material breach of these Terms, except to the extent caused by Fixture or another person for whom you are not legally responsible.

  1. Mandatory Legal Rights and Responsibilities

Nothing in these Terms removes or limits rights or obligations imposed by applicable federal, provincial or municipal law. If a provision conflicts with a mandatory legal requirement, the applicable legal requirement will govern.

  1. Changes to These Terms

Fixture may update these Terms when its Platform, service standards, business practices or legal obligations change. The effective date of the most recent version will be displayed. Where legally required, Fixture will provide additional notice or obtain consent before a material change takes effect.

  1. Governing Law and Disputes

Subject to mandatory rights and obligations that apply in the place where services are provided, these Terms are governed by the laws of [Insert Province/Territory, Canada] and the applicable federal laws of Canada.

Before starting formal proceedings, you and Fixture should make reasonable efforts to resolve a dispute through Fixture support. Nothing in this section prevents either party from using a court, tribunal, regulator or other process that cannot legally be restricted.
