Eze Fixture Customer App
Terms and Conditions
Effective Date: September 30, 2026
These Terms and Conditions (“Terms”) govern your use of the Fixture customer mobile application, website and related services (collectively, “Fixture” or the “Platform”). Fixture provides a technology platform that allows customers to request automotive services from independent repair professionals, mechanics, garages, tire shops and other service providers (“Service Providers”).
By creating an account, accessing Fixture, requesting a service or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use Fixture. These Terms should be read together with Fixture’s Privacy Policy, Cancellation Policy and Refund Policy.
You must be legally capable of entering into a binding agreement and must use Fixture only for lawful purposes. If you use Fixture on behalf of another person, business or organization, you represent that you are authorized to do so and that the information you provide is accurate.
Fixture may require account verification, authentication or other reasonable information before allowing access to some Platform features.
Fixture is a technology platform that helps customers request and coordinate automotive services with independent Service Providers. Automotive work requested through Fixture may be performed by independent repair companies, mechanics, garages or tire shops.
Unless applicable law provides otherwise, the Service Provider performing the work is responsible for the authorized service, the professional quality of that work, the tools and procedures used, and direct vehicle damage caused by its work, negligence, improper tools or incorrect procedures.
Fixture may facilitate booking, communications, service records, location functions, payment processing, refunds, customer support and dispute assistance. Fixture does not replace the Service Provider’s professional responsibilities.
You agree to provide accurate account and contact information and to keep that information reasonably current. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account, except to the extent caused by Fixture or otherwise provided by applicable law.
You should promptly notify Fixture if you believe your account or credentials have been accessed or used without authorization.
When requesting a service, you should provide accurate information reasonably necessary for the Service Provider to evaluate and perform the request, including the service location, vehicle make, model, year, tire size, rim size, vehicle category, issue description and any relevant service instructions.
A Service Provider may rely on the information supplied through Fixture. If the information is materially incomplete or inaccurate, the Service Provider may need to revise an estimate, decline the service or request additional authorization before continuing.
A service request is not guaranteed to be accepted. A Service Provider may accept or decline a request based on availability, service area, ability to perform the work, safety considerations or other legitimate reasons.
The Service Provider that accepts the job is responsible for performing the authorized service safely and professionally and for using appropriate tools, equipment and procedures. Fixture may assist with communications or support but does not assume the Service Provider’s professional obligations.
Fixture may display estimated prices, travel charges, service charges or other amounts associated with a request. Unless expressly stated otherwise, an estimate may change where the actual condition of the vehicle, required parts, travel circumstances or authorized scope of work differs from the information available when the estimate was prepared.
A Service Provider may perform only work authorised by you or included in the accepted Fixture service request. If additional work becomes necessary, the Service Provider should explain the additional work and obtain your authorization before performing or charging for it, except where immediate action is reasonably necessary to address an emergency safety situation.
You are not responsible for undisclosed or unauthorized services, charges, parts or fees merely because they were proposed by a Service Provider.
Payments may be processed through third-party payment processors. Fixture may receive and use transaction information such as payment status, transaction identifier, amount, refund information and limited payment-method details to operate the Platform and support the transaction.
You authorize the applicable payment processor to charge the payment method you select for amounts you approve through Fixture, including properly disclosed service charges, travel charges, parts, materials and other authorized amounts.
Where a payment processor directly collects card information, Fixture may not receive or store your complete payment-card number.
Before a Service Provider Accepts
If you cancel before a Service Provider accepts the job, no service cancellation charge will normally apply. Any eligible payment authorization or payment for an unperformed service will be cancelled, released or refunded as applicable.
After a Service Provider Accepts
If a Service Provider has accepted the order but has not yet incurred material travel or service costs, Fixture may allow cancellation without a charge. If the Service Provider has already begun travelling or incurred costs associated with the booking, a reasonable cancellation or dispatch charge may apply only where that charge was properly disclosed through the Platform.
After Arrival or Work Has Started
Once the Service Provider has arrived, inspected the vehicle or begun authorized work, amounts relating to travel, diagnosis, completed work, installed parts or consumed materials may be non-refundable. You may still dispute unauthorized, incomplete, defective or improperly performed work.
Service Provider Cancellation or No-Show
If a Service Provider cancels an accepted service, fails to attend or cannot perform the requested service, Fixture may attempt to assign another Service Provider. If the service cannot be completed, you will not be charged for work that was not performed, and eligible amounts already collected will be refunded or released.
Refunds may be approved where appropriate, including when you were charged for a service that was not performed, a Service Provider failed to attend, an incorrect or duplicate payment was processed, unauthorized work was charged, the amount charged materially differs from the authorized amount without your approval, a qualifying cancellation occurs, or Fixture determines that a refund is appropriate following a service dispute.
Completed and properly authorized services are generally not refundable solely because you change your mind after the work has been performed. Parts, consumable materials, properly disclosed travel charges or work already completed may also be non-refundable unless the service was defective, unauthorized or applicable law provides otherwise.
Approved refunds will normally be returned to the original payment method. The time for a refund to appear may depend on the payment processor and financial institution. Any refund timeframe or cancellation right required by applicable law takes priority over these Terms.
The Service Provider performing the work is responsible for direct vehicle damage caused by its work, negligence, improper tools, incorrect procedures or the actions of its employees or technicians. Depending on the circumstances, this may include scratched or damaged rims, torn or damaged tires, body damage, interior damage, improperly installed components or other direct damage caused while performing the authorized service.
If you believe your vehicle was damaged during service, notify Fixture and the responsible Service Provider as soon as reasonably possible and provide photographs, invoices, service records, inspection reports or other available evidence reasonably relevant to the complaint.
Fixture may assist with communication and dispute resolution. That assistance does not eliminate or replace the Service Provider’s legal responsibility for damage it causes, and nothing in these Terms limits rights or remedies available to you under applicable law.
Where applicable, the Service Provider should maintain an accurate record of the work performed and provide relevant service information after completion. A service record may include the work performed, vehicle information, tire pressure or PSI, wheel torque specifications or measurements, parts or materials installed, date and time of service, Service Provider information and other relevant job information.
Fixture may store these records as part of your service history.
You must not use Fixture to commit fraud, submit intentionally false service requests, harass or threaten Service Providers, interfere with Platform security, attempt unauthorized access, misuse another person’s account, or use customer-support or dispute features in bad faith.
You should treat Service Providers and their employees respectfully and provide reasonable access to the vehicle and service location necessary to perform the authorized work.
Fixture may use your current or precise location, subject to your device permissions, to identify your service location, locate nearby Service Providers, calculate travel distance, facilitate service delivery or display your position on a map.
Fixture may send service-related communications, notifications or authentication messages necessary to operate your account and orders. Your device or network provider may apply ordinary messaging, data or connectivity charges.
Fixture may rely on third-party providers for payment processing, cloud hosting, authentication, maps and geolocation, push notifications, application monitoring, analytics, crash reporting and customer support.
Third-party services may be subject to their own terms and policies. Fixture is not responsible for a third party’s independent acts or services except to the extent responsibility cannot legally be excluded.
Fixture’s collection, use, disclosure, retention and deletion of personal information is described in the Fixture Customer App Privacy Policy. By using the Platform, you acknowledge that information may be processed as described in that policy, subject to applicable privacy law.
When a service is requested, Fixture may provide the selected Service Provider with information reasonably necessary to perform the service, including your name, contact information, service location, vehicle information, requested service, scheduled time and relevant service instructions.
Fixture may restrict or suspend access where reasonably necessary to investigate fraud, misuse, safety concerns, unauthorized activity, repeated abuse of Platform processes or material violations of these Terms.
You may request deletion of your Fixture account through available account-management features or by contacting Fixture. Certain transaction, service, financial, fraud-prevention, dispute, safety or legal records may need to be retained after account deletion where reasonably necessary or legally required.
The Fixture name, Platform, software, interface, branding, graphics, text and other Platform materials are owned by Fixture or its licensors and are protected by applicable intellectual-property laws. Fixture grants you a limited, personal, non-exclusive, non-transferable and revocable right to use the Platform for its intended customer-service functions.
You may not copy, sell, sublicense, reverse engineer, interfere with or commercially exploit the Platform except where applicable law expressly permits such activity.
Fixture aims to operate the Platform reliably but does not guarantee uninterrupted or error-free availability. Service availability depends on factors including Service Provider availability, location, connectivity, third-party systems and the circumstances of the requested automotive work.
To the maximum extent permitted by applicable law, Fixture does not make warranties about the workmanship of independent Service Providers. Service Providers remain responsible for the quality, safety and legality of the automotive services they perform.
Nothing in this section excludes any warranty, condition, consumer right or remedy that cannot legally be excluded.
To the maximum extent permitted by applicable law, Fixture will not be liable for indirect, incidental, special, consequential or punitive losses arising solely from the independent acts or omissions of a Service Provider, third-party service or user. Fixture does not exclude liability that applicable law does not permit it to exclude.
This limitation does not remove the Service Provider’s responsibility for direct vehicle damage or other loss caused by its work, negligence, improper tools, incorrect procedures or personnel.
You are responsible for losses, claims or costs caused by your intentional misuse of the Platform, fraudulent activity, material violation of these Terms or unlawful conduct, except to the extent the loss was caused by Fixture, a Service Provider or another person for whom you are not legally responsible.
These Terms do not remove or limit mandatory consumer, contractual, privacy or other rights provided under applicable federal, provincial or municipal law. Where these Terms conflict with a mandatory legal requirement, the applicable legal requirement will govern.
Fixture may update these Terms when its services, technology, business practices or legal obligations change. The updated version will identify its effective date. Where legally required, Fixture will provide additional notice or obtain consent before a material change takes effect.
Subject to any mandatory rights that apply where you live or receive services, these Terms are governed by the laws of [Insert Province/Territory, Canada] and the applicable federal laws of Canada.
Before starting formal proceedings, you and Fixture should make reasonable efforts to resolve a dispute through Fixture customer support. Nothing in this section prevents either party from using a court, tribunal, regulator or consumer-protection process that cannot legally be restricted.
